Validity of Consent to Established beyond expectation!

Maharashtra Pollution Control Board has been released a circular to revise the validity of consent to established(CTE) to 10 years for infrastructure projects.

CTE-Consent to establish is NOC given by GPCB which is required before you start your business or enterprise as per The Water (Prevention & Control of Pollution) Act – 1974 and the air (prevention and control of Pollution) act, 1981. It is mandatory to obtain CTE from the respective State Pollution Control Board (GPCB) before the commencement of business. The Process requires the application in the prescribed format along with required documents and fees followed by Inspection.

Infrastructure projects are granted consent to establish by the Board, which is valid until the unit is commissioned or five years, whichever comes first. The Board has received requests from a variety of parties to synchronize or coincide the consent to establish’s validity with the validity of the environment clearance for ten years. The convenience of doing business for all stakeholders without having a negative impact on the environment may be increased by making the validity of the consent to establish extension synchronize with the Environment clearance validity for 10 years.

It was determined to change the validity of consent to established 10 years for infrastructure projects only coterminous with the validity of environment clearance for 10 years after a thorough discussion of the relevant matter in the Consent Appraisal Committee meeting. Additionally, project proponents who desire to get approval to establish for 10 years must pay two terms consent costs at the time of application.
