The Ministry of Commerce and Industry has been released notification on draft Explosives Rules. Explosives rule is basically a power for Central Government to prohibit the manufacture, possession or importation of specially dangerous explosives.
Explosives are any substance or device that can be made to produce a volume of rapidly expanding gas in an extremely brief period. There are three fundamental types: mechanical, nuclear, and chemical. A mechanical explosive is one that depends on a physical reaction, such as overloading a container with compressed air. Such a device has some application in mining, where the release of gas from chemical explosives may be undesirable, but otherwise is very little used. A nuclear explosive is one in which a sustained nuclear reaction can be made to take place with almost instant rapidity, releasing large amounts of energy. Experimentation has been carried on with nuclear explosives for possible petroleum extraction purposes. As per Explosives rule, 2008 license is mandatory for import or export of explosives and only such explosives which is “Authorized” under the Explosives Rules is allowed to be imported/exported.
As per new draft rules tow major changes shall be done, (i) A professional organization that has been approved by the Chief Controller of Explosives to conduct safety audits and inspections of major accident hazards premises as defined by the Manufacture, Storage and Import of Hazardous Chemicals Rules, 1989, and that has a minimum of three people is referred to as a third party inspection agency having at least a master’s degree in chemistry or a bachelor’s degree in chemical engineering from an accredited university, as well as at least ten years of expertise in the production and handling of explosives. (ii) Every application for renewal of the license shall be accompanied by the following documents, namely:-
- Application in Form RE-1;
- The original license:
- Prescribed renewal fee
- In case of Explosives Manufacturing Units, all the inspection or safety audit reports since last approval as per the Manufacture, Storage and Import of Hazardous Chemicals Rules, 1989 issued by Third Party Inspection Agency approved under these Rules.
