Right to express disagreement with observations made by GPCB

Gujarat Pollution Control Board has released a notice for site investigation observation note. An accordingly industrial unit representative has the right to express disagreement with observations made by the GPCB officer during the site inspection.

GPCB officers are instructed to record all observations made during the site inspection of the industrial unit and also guide industrial units to comply with actions. All these observations will be recorded in writing in a prescribed format and representatives from the industrial unit will be asked to sign as a token of acceptance to comply with such observations. The representative from the industrial unit has also the right to express disagreement with observations recorded in the writing.

If for serious violation of law, no action is taken by the authority, a citizen can approach the court of law after giving 60 days notice to GPCB.
