Introduction
The Ministry of Environment, Forest & Climate Change has issued a new notification concerning the Coastal Regulation Zone (CRZ) under the Environment Protection Act, 1986. This update revises the Coastal Regulation Zone Notification, 2011, which previously established restrictions on setting up or expanding industries and activities in designated coastal areas.
Notification Details
The Coastal Regulation Zone Notification, 2011, mandated restrictions on the establishment and expansion of industries within the CRZ. This latest notification affirms that clearances granted under the CRZ Notification, 2011, remain applicable to new projects, activities, and expansions within these regulated zones, provided they are listed in the EIA Notification Schedule and have received Environmental Clearance (EC). The validity of the CRZ clearance is set for ten years.
Extension of Validity
The validity period of the CRZ clearance may be extended by up to one year if the applicant submits an extension request within the original clearance period, accompanied by recommendations from the Coastal Zone Management Authority (CZMA).
For applications submitted:
1. Within Thirty Days Post-Expiry: The head of the division in the Ministry of Environment, Forests, and Climate Change or the CZMA member-secretary can condone the delay. Subsequently, they will forward the application to the appropriate authority for consideration.
2. Between Thirty and Ninety Days Post-Expiry: The Minister in charge or the CZMA chairperson may condone the delay. Subsequently, the appropriate authority will then review the application.
3. Beyond Ninety Days Post-Expiry: Applications for extension will not be entertained.
Conclusion
This notification reinforces the regulations governing coastal areas and provides clear guidelines for extending project clearances. Consequently, the Ministry’s approach aims to ensure compliance and environmental protection while also accommodating project timelines. Furthermore, by setting these guidelines, the Ministry addresses both regulatory needs and practical considerations, ensuring a balanced approach to development and environmental stewardship.
