E-Waste (Management) Second Amendment Rules, 2023

The Ministry of Environment, Forest & Climate Change has released the E-Waste (Management) Second Amendment, 2023, which states the following:

Amendment to Rule 5:

  1. In the E-Waste (Management) Rules, 2022 (hereinafter referred to as the said rules), in rule 5, after clause (3), insert the following clause: “You must adopt approved destruction technologies to manage refrigerant generated during the manufacture of refrigeration and air-conditioning equipment, following the guidelines issued by the Central Pollution Control Board.”

Amendment to Rule 7: 

In rule 7 of the said rules, after clause (4), insert the following clause: “You must adopt approved destruction technologies to manage refrigerant generated from the end-of-life refrigeration and air-conditioning equipment, in accordance with the guidelines issued by the Central Pollution Control Board.”

Amendment to Rule 9: 

In rule 9 of the said rules, after clause (10), insert the following clause: “You must adopt approved destruction technologies to ensure secure, accountable, and sustainable management of refrigerant generated from the end-of-life refrigeration and air-conditioning equipment, as per the guidelines issued by the Central Pollution Control Board.”

Amendment to Rule 14: 

In rule 14 of the said rules, in sub-rule (1), in clause (ii), after sub-clause (b), insert the following sub-clause: “(c) In the case of multiple end products of recycling, determine the conversion factor for the generation of the extended producer responsibility certificate, as per the guidelines issued by the Central Pollution Control Board with the approval of the Steering Committee.”

Amendment to Rule 16: 

In rule 16 of the said rules:

  • (a) Substitute the following sub-rules for sub-rule (2): “The provisions of sub-rule (1) shall not apply to components or consumables or parts or spares required for electrical and electronic equipment specified in Schedule – II B placed in the market on or before the 1st May, 2014, provided that reduction of hazardous substances compliant parts and spares are not available. The provisions of sub-rule (1) shall not apply to electrical and electronic equipment specified in Schedule – II C placed in the market on or before the 1st April, 2025. The provisions of sub-rule (1) shall not apply to components or consumables or parts or spares required for electrical and electronic equipment referred to in sub-rule (2A) until the 1st April, 2028, provided that reduction of hazardous substances compliant parts and spares are not available.”
  • (b) In sub-rule (3) and sub-rule (13), insert the words “and Schedule II A” after the words “Schedule II.”

Changes in Schedule-II: 

In Schedule-II to the said rules, in the Table, omit S.No. 37 and the entries related to it.
