Simplifying Consent Mechanisms for Low-Pollution Industries
Introduction
On November 12, 2024, the Ministry of Environment, Forests, and Climate Change issued a landmark Water Act Exemption Notification exempting low-pollution industries from specific provisions of the Water (Prevention and Control of Pollution) Act, 1974. This move is a significant step towards reducing compliance burdens while maintaining environmental safeguards. Here’s a closer look at what this means for industries and the environment.
Water Act Exemption Notification: Streamlining Compliance for White-Category Industries
Industries with a pollution index score of up to 20, classified under the “white category” by the Central Pollution Control Board (CPCB), are now exempt from obtaining prior consent under Section 25 of the Act. These industries, including assembly units, fly ash brick manufacturing, and handloom operations, are characterized by minimal environmental impact. To avail of this exemption, they must notify their respective State Pollution Control Boards (SPCBs) in writing.
Additionally, industrial plants with prior environmental clearance under the Environment Protection Act, 1986, are also exempted. These measures simplify operational processes for low-risk industries, reduce administrative delays, enhance operational efficiency, and encourage compliance while ensuring accountability through mandatory notification and routine environmental performance assessments.
Conclusion
This progressive notification balances the twin goals of promoting industrial ease of business and environmental protection while ensuring transparency and accountability. It underscores the government’s commitment to fostering a sustainable industrial ecosystem, encouraging innovation, and supporting green practices. By focusing regulatory efforts on high-pollution sectors, this initiative sets a precedent for pragmatic environmental governance that benefits both industries and communities.
