Environment (Protection) Fourth Amendment Rules, 2023

The Ministry of Environment, Forest & Climate Change has released the Environment (Protection) Fourth Amendment Rules, 2023. These new rules introduce an important addition to Schedule I of the Environment (Protection) Rules, 1986, specifically targeting the condition governing the supply of Generators (Genset) and Genset engines.

In the revised schedule, under serial number 88, item “C. the General Condition”, condition 12 has been updated to include a new proviso. This proviso states that the supply of Gensets and Genset engines, for which purchase orders were received by manufacturers on or before June 30, 2023, will be allowed until June 30, 2024, in accordance with the norms defined in the existing condition.

This amendment aims to provide flexibility to manufacturers and suppliers who were impacted by the timeline for compliance with the existing regulations. It acknowledges the challenges faced by manufacturers who had already received orders but were unable to fulfill them due to the earlier deadlines. By extending the timeline for these orders, the government intends to ensure that the transition to more stringent environmental norms does not disrupt the market and ongoing business commitments.

This extension aligns with the broader objectives of environmental protection while maintaining business continuity. Manufacturers who received purchase orders by June 30, 2023, now have an additional year to comply with the stipulated norms, offering them more time to meet the requirements set out under the Environment (Protection) Rules.

It is important for manufacturers, suppliers, and stakeholders in the Genset and Genset engine industries to be aware of this extension and ensure compliance with the updated conditions. This step demonstrates the government’s commitment to balancing environmental regulation with practical considerations for businesses in affected industries.
