Disaster Management Bill 2024 – A Key Updates
On August 1, 2024, the Lok Sabha introduced the Disaster Management (Amendment) Bill, 2024. This bill, in turn, aims to revise the Disaster Management Act, 2005. Consequently, the amendment seeks to enhance the disaster management framework of India. By addressing existing gaps, the bill intends to improve the overall effectiveness. Additionally, it clarifies definitions for improved implementation. Therefore, the proposed changes aim to streamline and strengthen disaster management efforts across the country.
Clarification of “Manmade Causes”
The amendment, therefore, inserts an explanation in Section 2, clause (d). Specifically, this explanation states that “manmade causes” do not include law and order-related situations. Consequently, this clarification ensures that incidents arising from law enforcement issues are not categorized under disaster management. Thus, the focus of resources will be directed towards natural and other manmade disasters.
Introduction of “Disaster Database”
A new clause (da) is added in Section 2, defining a “disaster database.” This database will encompass disaster assessment, fund allocation details, expenditures, preparedness, mitigation plans, and risk registers based on the type and severity of risks. This structured database aims to enhance the efficiency and effectiveness of disaster response and management by providing comprehensive and accessible information.
Day-to-Day Functions of the National Authority
A new sub-section (3A) is introduced in Section 3, specifying that the Vice-Chairperson of the National Authority will primarily handle its day-to-day functions. Moreover, in the absence of the Vice-Chairperson, a member designated by the Chairperson or Vice-Chairperson will take over. Ultimately, this change aims to streamline the operations of the National Authority, ensuring continuity and efficiency in disaster management activities.
Omission of Section 19
The amendment proposes the omission of Section 19 of the principal Act. Although the details of this omission are not specified in the provided summary, these changes typically aim to remove redundant or outdated provisions. Consequently, this contributes to a more streamlined legislative framework.
Inclusion of the Director General of Police in State Executive Committees
In Section 20, sub-section (2), a new clause (c) is inserted, making the Director General of Police of the State an ex officio member of the State Executive Committee. This inclusion ensures that law enforcement perspectives are integrated into state-level disaster management, promoting a holistic approach to disaster preparedness and response.
The Disaster Management (Amendment) Bill, 2024, represents a significant step towards enhancing India’s disaster management framework. By clarifying definitions, introducing comprehensive databases, and ensuring streamlined operations and integrated perspectives, the amendment aims to build a more resilient and responsive disaster management system.
